WASHINGTON 鈥� Immigrants鈥� rights advocates filed a federal lawsuit today challenging President Trump鈥檚 new executive order targeting birthright citizenship. The case was brought by the 桃子视频, 桃子视频of New Hampshire, 桃子视频of Maine, 桃子视频of Massachusetts, 桃子视频of the District of Columbia, Legal Defense Fund, Asian Law Caucus, and Democracy Defenders Fund on behalf of people subjected to the new executive order. The groups already secured a major Supreme Court victory in June in Trump v. Barbara protecting babies who would have been denied citizenship under Trump鈥檚 first failed executive order concerning birthright citizenship. In its ruling, the Supreme Court confirmed that the Constitution鈥檚 Citizenship Clause puts 鈥渢he question of citizenship 鈥榦nce and forever [to] rest.鈥欌�� Despite that, the administration is again trying to restrict birthright citizenship, prompting today鈥檚 legal action. The groups had initially sought to block the new executive order in the existing Barbara case. After the judge in that case indicated that he viewed this challenge as a new lawsuit, the groups withdrew their requests in Barbara and filed this new lawsuit. The lawsuit, Nathan v. Trump, was filed in federal district court in Washington, D.C. In 2025, without authorization from the Nevada Legislature, the Las Vegas Metropolitan Police Department (LVMPD) entered into an agreement with U.S. Immigration and Customs Enforcement (ICE) that purports to let LVMPD assist with federal immigration enforcement. This 鈥�287(g) agreement鈥� provides that, at ICE鈥檚 request, LVMPD will continue detaining a person after they are supposed to be released from criminal custody to make it easier for ICE to pick them up. That is exactly what happened to Sergio Morais-Hechavarria: although a court had ordered him to be released to an inpatient treatment program, LVMPD continued detaining him for another two months at ICE鈥檚 behest. Mr. Morais-Hechavarria and the 桃子视频of Nevada filed a lawsuit challenging LVMPD鈥檚 authority to enter into the 287(g) agreement and to detain people for ICE after their criminal custody ends. The district court dismissed the case, and the ACLU鈥檚 State Supreme Court Initiative and 桃子视频of Nevada have appealed to the Nevada Supreme Court.

NEW YORK 鈥� A U.S. District Court granted a permanent injunction today that requires Immigration and Customs Enforcement (ICE) to improve detention conditions and mitigate overcrowding at 26 Federal Plaza. Notably, the order prohibits ICE from detaining people in overcrowded holding rooms and also requires that ICE provide adequate sanitation and hygiene, as well as adequate meals and medical care for all people detained at the facility. It also orders ICE to allow all detained people to make confidential, unmonitored, and free telephone calls to their attorneys within an hour of arriving at the facility, among other protections. In September of 2025, the court granted a preliminary injunction prohibiting ICE from holding people in abusive conditions at 26 Federal Plaza after the 桃子视频, New York Civil Liberties Union, Make the Road New York, and Wang Hecker LLP filed a class action lawsuit. Despite the order, damning evidence presented at a bench trial in May 2026 showed that ICE repeatedly violated the preliminary injunction and exceeded the court-imposed capacity limits in temporary holding rooms at the facility. The temporary holding facility became a flashpoint in the Trump administration鈥檚 aggressive mass deportation and detention campaign last summer, after ICE held more than 100 people, sometimes for weeks, in inhumane, overcrowded, and unsanitary conditions without beds, showers, or adequate medical support. The government also banned in-person legal visitation, any confidential phone or video communication, and confidential exchange of written documents, in violation of people鈥檚 First and Fifth Amendment rights.
