Thousands of school districts across the country operate with nondiscrimination policies inclusive of their transgender students, including the legal right for these students to access facilities (bathrooms, locker rooms, etc.) consistent with their gender identity. These policies help protect transgender students from harassment, being isolated from their peers, and thrive in a learning environment that believes in their fundamental rights.

Families, transgender adolescents, and their medical providers are challenging a new law, signed by Governor Kevin Stitt in May 2023, that imposes criminal penalties on healthcare providers who provide age-appropriate medical care for transgender adolescents. Such restrictions are opposed by leading medical experts and organizations, including the American Medical Association, the American Psychiatric Association, and the American Academy of Pediatrics. According to the Williams Institute of UCLA, there are an estimated 2,600 transgender youth ages 13-17 in Oklahoma.

Nine Oklahoma residents and a nonprofit organization dedicated to supporting public education in Oklahoma filed a lawsuit in July 2023 in state court to stop Oklahoma from sponsoring and funding the nation鈥檚 first religious public charter school, St. Isidore of Seville Catholic Virtual School. The plaintiffs are faith leaders, public school parents, and public education advocates who object to their tax dollars funding a public charter school that will discriminate against students and families based on their religion and LGBTQ+ status, fail to adequately serve students with disabilities, and indoctrinate students into one religion 鈥� all in violation of Oklahoma law and our country鈥檚 promises of the separation of church and state and public schools that are open to all.

This long-running Oklahoma death-penalty case raised two issues:   1) Would the State of Oklahoma be permitted to execute Glossip, despite overwhelming evidence that he is innocent, and despite a confession by the State鈥檚 Attorney General that the state obtained his conviction by hiding crucial evidence impeaching its star witness?; and   2) Would the Court reaffirm its longstanding commitment to Due-Process-Clause precedent requiring the government to disclose favorable evidence in its possession to the accused and to correct false testimony introduced against the accused?

Whether the Oklahoma Department of Education can sue the Freedom From Religion Foundation for exercising its constitutionally protected speech and petition rights to send advocacy letters to government actors it believes are violating the law.
